Liability Waiver and Terms of Service

This Liability Waiver and Terms of Service (the "Agreement") is made and entered into by and between Card Academy Grading, LLC, hereinafter referred to as "CAG," and the individual or entity submitting cards for grading, hereinafter referred to as the "Client." By submitting cards to CAG for grading, the Client agrees to the following terms and conditions:
1. Refund Policy
All fees paid to CAG for grading services are non-refundable, except in the event of a clerical error on the part of CAG. In such cases, CAG will rectify the clerical error but will not issue any refunds.
2. Finality of Grades
All grades issued by CAG are final. Should the Client wish to request a regrading of their card, a new grading request must be submitted, and the applicable grading fee must be paid. There is no assurance that the grade will change upon regrading. The Client acknowledges that they are paying for CAG’s professional opinion regarding the grade of the card.
3. Cross Grading and Submission Requirements
CAG does not provide cross grading services. Cards submitted to CAG must be in raw, ungraded condition. CAG will not accept cards already encapsulated or graded by any other grading entity. CAG will not perform the cracking or opening of slabs from other grading companies. All submissions must consist solely of raw cards.
4. Return of Sleeves and Top Loaders
CAG will not return any card sleeves or top loaders provided with the submitted cards. Such items will be discarded following the completion of the grading process. 5. Courier and Handling Risks
The Client acknowledges and accepts that sending cards through the mail involves inherent risks. CAG assumes no liability for any damage, loss, or alteration that occurs during transport or handling by courier services. CAG is not responsible if a card arrives in a condition that differs from its original state.
6. Creative Control of Custom Labels
CAG maintains sole and exclusive creative control over all custom labels produced. Should the Client wish to incorporate their own Name, Image, or Likeness (NIL) into custom labels, an additional fee will be required, based on the nature and extent of the requested modifications.
7. Grade Disputes
The grading decisions rendered by CAG are based on the professional judgment of CAG’s in-house grading experts. CAG will not engage in discussions or provide explanations regarding specific grades. Any disputes or complaints regarding assigned grades will be disregarded. The Client acknowledges that they are paying for CAG’s expert opinion and is encouraged to direct any inquiries or seek clarification prior to the submission of cards.
8. Ultrasonic Welding and Slab Condition
Due to the sensitivity of encapsulation machines, some slabs may exhibit slight flashing. This phenomenon is a normal byproduct of the ultrasonic welding process and in no way impacts the card itself. Cards will not be regraded due to light flashing on the slab.
9. Damaged Packages
In the event that CAG receives a package in a visibly damaged condition, CAG will not open or inspect the contents. Instead, such packages will be returned to the Client in their original state, placed within an additional protective box to prevent further damage. CAG shall bear no responsibility for the contents of damaged packages.
General Provisions
• Modification of Terms: CAG reserves the right to amend or modify these terms and conditions at its sole discretion. The Client is responsible for reviewing and understanding the current version of this Agreement prior to the submission of any cards.
• Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state in which CAG is headquartered, without regard to its conflict of law principles.
• Severability: Should any provision of this Agreement be deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.
By submitting cards to CAG for grading, the Client acknowledges that they have read, understood, and agree to be bound by the terms and conditions set forth in this Liability Waiver and Terms of Service.
